Texas Sweepstakes Casinos: Consideration, mail promotions and operator evidence
Texas casino sweepstakes comparisons require two different checks: the legal treatment of consideration and the operator’s actual prize-mode admission documents. A general US clause, an explicit Texas statement and state legal approval are different findings.

The official state table explicitly marks Texas Yes for Social Casino. Consideration, mail promotions and operator evidence
Penal Code Chapter 47 defines lotteries through chance, prizes and consideration and separately addresses gambling devices. Attorney General Opinion JC-0482 examines a particular donation-linked promotion, explaining why free entries for some people do not necessarily remove consideration supplied by others. The donation context and March 25, 2002 date remain important limits on that opinion.
Business and Commerce Code Chapter 622 concerns qualifying mail-conducted promotions. Its no-purchase and equal-treatment requirements cannot be borrowed as universal permission for an online casino simply because that platform also accepts postal entry requests.

Six conditional document checks, with two partners withheld
The retained operator table preserves the individual October 20 evidence for Clubs Poker, High 5 Casino, Spree, Zula Casino, YAY Casino and Stake.us. These six checks support conditional policy listings. They do not approve a specific Texas account, transaction, game or prize promotion under state law.
Casino.click and FreeSpin remain withheld from Texas signup because conflicting entertainment-only and prize-play terms responses leave the applicable mode unresolved. Their evidence references below are plain text, not signup routes. A favorable US residence clause does not cure the unresolved document conflict.
Texas prize-mode policies: eight separate document checks
The six conditional policy findings below come from the October 20, 2026 document baseline. They are admission-policy findings, not Texas legal approvals. Casino.click and FreeSpin remain withheld; their conflicting terms are identified as plain-text evidence references.
Texas operator-document baseline — October 20, 2026
The baseline rules admit legal US residents outside their named exclusions. Terms clause 3.5 adds game/service jurisdiction restrictions, including Indiana. Texas appears in neither relevant exclusion set: the positive US clause covers it without naming it individually. Read the linked customer acceptance policy with both documents.
The operator’s state table marks Texas Yes for Social Casino. The baseline check does not rely on that table alone: sweepstakes rules 2.1 and platform Terms 3.1.4 separately provide US admission clauses whose exclusions do not include Texas. The Texas marketing page is supporting context, not the prize-mode proof.
Rules clause 2.1 admits legal US residents outside Prohibited Territories. Terms clause 3.4 supplies the full baseline exclusion set for residence and access. Texas falls within the positive US scope and is not listed as excluded; the finding does not depend on an explicit named-Texas sentence.
The baseline must combine all incorporated documents. The participant requirements cover residence and physical presence in permitted US states/DC; newer sweepstakes rules impose further prize-mode exclusions. Neither set excludes Texas. Apply the narrower combined requirements, not one favorable document in isolation.
Texas is covered through the documents’ positive US territorial scope. The incorporated participant requirements address both residence and physical presence in permitted states/DC, and the newer sweepstakes rules add prize-mode exclusions. Texas is absent from both excluded sets. The combined, narrower requirements govern this policy finding.
Terms 2.5 positively covers customers in the continental US and Hawaii outside Excluded Territories. Clause 4.2 applies that location condition to Standard and Promotional Play, and clauses 8 and 11 describe Stake Cash prize play. Texas is within the positive territory and not an exclusion at this baseline.
Rules 2.1 supplies a positive US-residence clause that would include Texas outside its exclusions. However, the retained terms response contains materially different entertainment-only and prize-play versions. That unresolved conflict prevents verification of the applicable Texas prize mode, so no signup route is supplied.
The rules’ positive US-residence clause in 2.1 would encompass Texas outside the exclusions. The terms response nevertheless contains materially different entertainment-only and prize-play copies. Because the applicable Texas prize mode remains unresolved, this baseline withholds signup rather than treating the favorable clause as sufficient.
Does a postal-entry option make Chapter 622 universal?
No. The chapter expressly concerns qualifying mail-conducted promotions. That scope must remain visible rather than being expanded into general internet-casino authorization.
Why are the two featured partners absent from Texas signup?
Their retained terms responses contain materially different entertainment-only and prize-play variants. The baseline does not establish the applicable Texas prize mode strongly enough for signup. Their national featured placement cannot override this state gate.
Texas listings must continue to use complete per-operator document checks. Keep the six conditional findings distinct from legal approval, and keep both unresolved partner signups withheld.
