The value test and social-gambling defense
The statutory chapter separates participation, promotion and devices into different provisions. A clear analysis needs to identify the conduct being discussed rather than treating every provision as interchangeable. A virtual coin name also leaves open what a customer can win or exchange.
Section 712-1231 adds a conditional affirmative defense for social gambling. That is a legal category with conditions, not a marketing permission available whenever a commercial website describes its players as a community.
| Record | Local evidence and scope |
|---|---|
| 1 | Hawaii Revised Statutes 712-1220 defines gambling around risking something of value on chance or a contingent event for something of value. |
| 2 | The same statutory framework addresses promoting gambling, gambling devices and gambling participation in separate sections. |
| 3 | Section 712-1231 provides a conditional affirmative defense for social gambling; the word “social” in a casino’s branding does not itself satisfy that defense. |

Trace the award beyond the screen
Distinguish a balance usable only for entertainment from an opportunity connected to an external prize. Then look at the purchase relationship and the conditions of the asserted social-gambling defense. A platform’s own description cannot establish all those facts.
The baseline did not establish operator-specific Hawaii authorization for the independent prize models in the directory. This article consequently explains the statutory framework and links the primary material without assembling a local signup list from national promotions or an accessible registration form.
Hawaii questions
Does a social-casino name establish the defense?
Section 712-1231 requires its actual conditions to be met. The label on an app or website does not show that its participants, commercial structure and games satisfy those conditions.
Why examine a coin’s redemption function?
Section 712-1220 asks about value risked and a possible return of value. The purpose and exchangeability of a credit help describe the actual arrangement. Calling it virtual leaves those important facts unanswered.

The Hawaii comparison begins with value and the complete arrangement, then asks whether a specific defense applies. Branding cannot perform either part of that analysis.
