Promotion conditions and the café opinion
The Prize Promotions Act protects nonpurchase entrants against purchase or consideration requirements and disadvantage, while excluding arrangements that are otherwise unlawful. That recognizes a qualifying promotional category without resolving every casino-style currency design.
The 2014 Attorney General opinion concerns the described product-linked sweepstakes café. Its unfavorable analysis remains relevant context for the relationship between the sale and the game. It should neither be erased by the promotion statute nor inflated into an individual adjudication of every remote website.
Colorado: official evidence retained from the October 20, 2026 baseline
Record
Local evidence and scope
1
Colorado’s Prize Promotions Act recognizes qualifying sweepstakes that are not otherwise unlawful and protects nonpurchase entrants against purchase or consideration requirements and disadvantage.
2
The 2014 Attorney General opinion rejected the specified product-linked sweepstakes-café arrangement.
3
SB 26-163 expands premises-investigation authority from August 12, 2026; it does not create a general online-casino permission.
Published availability is a conditional comparison
Colorado is one of the states where this baseline supports a factual comparison of operators whose published prize-play rules include the location. Inclusion records a policy finding; it does not represent a Division license, state endorsement or a conclusion about the complete product’s legality.
SB 26-163 supplies a separate 2026 development: expanded premises-investigation powers from August 12. It does not create general internet-casino permission. For any listed operator, the real free route, purchaser advantages and current exclusions still need to satisfy their own checks before relying on admission.
The cited SB 26-163 record concerns gaming regulation and investigation authority at suspected unlicensed premises. It is not evidence that Colorado created a general license for remote dual-currency casinos on August 12.
Why can a conditional list appear beside an adverse opinion?
The sources address qualifying promotions and a specific café arrangement. A list can describe published operator admission rules while openly preserving that contrary context. It cannot certify that every listed product satisfies Colorado law.
